DYNAMIC PROPERTY SERVICES LTD • STANDARD SERVICE AGREEMENT

These Terms and Conditions govern all property repair, maintenance, and home improvement services provided by Dynamic Property Services LTD (hereafter referred to as the \"Property Service Technician\") to the client (hereafter referred to as the \"Client\"). By requesting, scheduling, or authorizing work, the Client agrees to be bound entirely by the terms outlined below. Going forward in this document, the Property Service Technician shall be referred to simply as \"the Technician.\"

1. ESTIMATES, SCOPE OF WORK, AND ACCEPTANCE

\nDefinition and Accuracy of an Estimate: Any cost estimate provided by the Technician is a preliminary, good-faith assessment based strictly on the information, photos, dimensions, and project descriptions provided by the Client. The Client explicitly acknowledges that the Technician does not always perform an on-site physical inspection before issuing an estimate. The final accuracy of the estimate depends heavily on the accuracy of the Client's provided details. Estimates are strictly for planning purposes and do not constitute a guaranteed final price.
\nClient Acceptance Required: No work will begin, and no project will be placed on the schedule, until the Client provides explicit written or verbal acceptance of the estimate through our online scheduling platform or designated communication channels.
\nHidden Conditions & Outside Scope Liability: If the Technician discovers unforeseen or hidden issues upon commencing work (such as concealed structural rot, faulty behind-the-wall wiring, or active plumbing leaks), all activity will stop immediately. The Technician disclaims all liability for pre-existing conditions or operational issues discovered outside the original scope of what was estimated. The technician will communicate the problem or concern and will only proceed at the direction or in the direction approved by the client. Standard rates will apply.

2. SERVICES PROVIDED & MATERIAL PROCUREMENT

\nServices Provided: The Technician operates as a specialized service provider for minor home repairs, installations, assemblies, and maintenance. The Technician does not perform major trade work requiring specialized municipal engineering or mechanical licensing (such as primary electrical main overhauls or major HVAC installations) beyond what is legally permitted for unlicensed contractors in this jurisdiction.
\nMaterial Supply: Unless explicitly agreed otherwise in writing, the Client is responsible for the cost of all materials and parts required for the project. If the Technician secures materials on behalf of the Client, a standard handling, sourcing, and transportation markup will be added directly to the final invoice.

3. PRICING, INVOICING, AND LOGGING HOURS

\nSystem Recorded Hours: For all projects billed on an hourly or time-and-materials basis, labor is tracked and recorded dynamically through the Technician’s system. If a customer has a dispute, they are encouraged to contact the Technician immediately to discuss it; however, the hours recorded in our tracking system remain the final, authoritative baseline used for the invoicing process.
\nProject Scope Changes: Any modifications, additions, or deletions to the project requested by the Client after work has begun will be treated as a change to the scope. These changes will be tracked dynamically and will be directly reflected in the final invoice without requiring an entirely new standalone contract.

4. PAYMENT TERMS, METHODS, AND LATE FEES

\nPayment Due Date: Payment is due within seven days upon receiving the invoice. For multi-day or multi-phase projects, progress invoices may be issued at the end of each work week or project phase and are due upon receipt.
\nAccepted Payment Methods: Payments may be safely made via Cash, Check (payable to Dynamic Property Services LTD), or secure electronic transfer (e.g., Bank E-Transfer). Credit card payments are accepted but are subject to a standard processing fee to cover platform merchant costs.
\nLate Fees and Collection: Overdue accounts will accumulate interest at a rate of 1.5% per month (18% per annum) on the unpaid balance, calculated from the original due date. The Client agrees to pay all collection, legal, and administrative costs incurred by the Technician to recover unpaid balances.

5. CLIENT RESPONSIBILITIES & SITE ACCESS

\nSite Preparation & Access: The Client must ensure the Technician has unhindered access to the work site during scheduled hours, including nearby parking options and clear access to functional utilities (electricity and water).
\nPre-Work Clearing: The Client must clear the immediate work area of fragile items, furniture, personal property, and valuables prior to the Technician's arrival. The Technician is not responsible for responsible for moving personal items and disclaims all liability for accidental damage to items that were not cleared.
\nSanitary Work Environment: The client needs to remove any unsanitary conditions such as in the bathrooms around the toilets, sinks, and any animal waste or personal waste. We require a clean and sanitary area to work and we maintain the right to refuse to work in unsanitary conditions.
\nSafety of Pets and Children: For safety reasons, the Client must keep children and domestic pets strictly away from the active work zone, tools, and equipment at all times.

6. LIMITED WARRANTY & LIABILITY LIMITATIONS

\nWorkmanship Warranty: The Technician provides a limited 30-day warranty on workmanship, ensuring that services are performed in alignment with the approved project estimate and completed to standard technical competencies. In the event that any portion of the workmanship is asserted by the Client to be unsatisfactory, the Technician will review the claim; any subsequent remedial actions, modifications, or re-performance of services shall be undertaken solely at the absolute discretion of the Company.
\nWarranty Exclusions: This warranty does not cover defects or failures in client-supplied materials, fixtures, or appliances; normal wear and tear; structural settling; or any modifications made by the Client or a third party after the Technician completes the work.
\nLimitation of Liability: To the maximum extent permitted by law, the Technician's total financial liability for any claim, loss, or property damage shall not exceed the total amount actually paid by the Client to the Technician for that specific project. The Technician is not liable for indirect, incidental, or consequential damages.

7. DISPUTES AND AMICABLE SETTLEMENT

\nDispute Resolution: If the Client is dissatisfied with any part of the service or has questions about their bill, they agree to contact the Technician directly to discuss the matter. The Client agrees to notify the Technician in writing within seven (7) business days of invoice receipt and allow a minimum of fourteen (14) business days to inspect, discuss, and attempt to resolve the issue amicably before pursuing external action.

ELECTRONIC ACCEPTANCE NOTICE

BY CLICKING \"APPROVE\", \"ACCEPT\", OR OTHERWISE MATERIALLY AUTHORIZING AN ESTIMATE THROUGH OUR ONLINE PLATFORM, THE CLIENT EXPLICITLY ACKNOWLEDGES THAT THEY HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY ALL THE TERMS AND CONDITIONS OUTLINED ABOVE. ONLINE APPROVAL OF THE ESTIMATE CONSTITUTES A VALID BINDING DIGITAL SIGNATURE AND AUTHORIZATION FOR WORK TO COMMENCE.
